That is not quite true.

The FSDG *does* require that *all* files be freely distributable.
It's the other 3 freedoms that are relaxed (use, modify, share
modifications).

Put another way: A user needs to be allowed to make a DVD of the
entire FSDG system, and be allowed to sell it.  Therefore, all assets
we distribute (functional or not) need to be freely distributable,
including commercially.

Therefore, CC-ND is OK, but CC-NC is not.

A game that downloads -NC assets that are not included in the package
is an interesting question.  My gut reaction is that it's a loophole
and still violates the intent of the FSDG.
